Contracts

- Free hosting contract

We strongly recommend that you sign a free accommodation contract when you move in, explicitly stating the duration and terms of your stay !

In this way, all parties are covered in the event of disagreement.

Nota Bene : Depending on the number of hours of service provided by the hirer, the form of contract may change.

- The rental contract

the rental agreement, practical when the services rendered are of lesser value than the accommodation. This is a furnished lease where the rent is paid in kind.

The only difference: the list of work to be done, the number of hours and the schedule must be appended to the lease.

The services rendered must not prevent the tenant from pursuing a professional activity in parallel. In this case, no URSSAF (in France) declaration is required.

- The intergenerational cohabitation contract

The intergenerational cohabitation contract enables senior citizens to rent or sublet part of their home to young people under the age of 30 in exchange for a moderate rent.

- The employment contract

The employment contract: is to be set up if the value of the services rendered is greater than that of the accommodation, then this is a domestic employee employment contract which provides for “company accommodation”.

In this case, the latter is classified as a benefit in kind and deducted from or fully covered by the employee's remuneration.

The owner must make a declaration to URSSAF (only for France) as a private employer..

- "Au pair" contract

The "au pair" employee contract: This is a family employee hired by a private individual to carry out home tasks (cleaning, ironing, childcare...) in return for remuneration consisting exclusively of benefits in kind (accommodation, food...). Once again, URSSAF must be declared.

Nota Bene :If there is any income generated by the accommodation in return for services, this must be declared by the owner, who must include it in his tax return. The tenant, for his part, must ensure that the amount of the rent reduction or free accommodation granted is in line with the minimum wage and current legislation.

Rules and regulations

This means that anyone can be accommodated free of charge. There are, however, a few rules to be observed.

Concerning the person being accommodated :

  • Draw up a free accommodation contract with the Host to justify your situation to the authorities
  • A certificate of free accommodation for certain administrative procedures
  • Declare your situation to the authorities (taxes, etc.)
  • If you live alone in the property - Have home insurance - Pay council tax

Concerning the Host :

  • Draw up a free accommodation contract with the guest to justify your situation to the authorities.
  • Declaring your free accommodation to the authorities enables you to calculate grants.
